Terms of Use

Effective date: October 28, 2026

Last updated: October 28, 2026

These Terms of Use (“Terms”) are an agreement between you and Stokes & Associates, Inc. (“Stokes & Associates,” “we,” “us,” or “our”) governing your access to and use of www.stokes-associates.com and any related pages, forms, downloads, and content we make available through it (the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. No professional relationship and no professional advice

The Site is provided for general informational and marketing purposes only.

  • Nothing on the Site is vocational rehabilitation, life care planning, rehabilitation counseling, psychological, medical, economic, financial, or legal advice, and nothing on it should be relied on as a substitute for a professional evaluation of an individual case.
  • Viewing the Site, downloading material from it, subscribing to our mailing list, or submitting a referral or inquiry does not create an expert-client, counselor-client, evaluator-evaluee, consulting, or other professional relationship between you and Stokes & Associates or any of our professionals.
  • We accept engagements only through a written agreement, after the necessary conflict check is complete. Until then, no obligation of confidentiality attaches to anything you send us.
  • Case outcomes depend on facts, jurisdiction, record evidence, and many other variables. Descriptions of our experience, qualifications, publications, prior testimony, or past assignments are not a prediction, guarantee, or warranty of any result in any matter.

If you need a vocational rehabilitation assessment, life care plan, labor market analysis, or expert opinion, contact us directly so we can discuss the engagement.

2. Who may use the Site

The Site is intended for a professional audience — attorneys, insurers, employers, claims and risk professionals, medical and rehabilitation colleagues, and others with a business interest in our services. You must be at least 18 years old to submit information through the Site. Do not use the Site if you are barred from doing so under applicable law.

3. Permitted use

We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site and to view, download, and print its content for your own internal, non-commercial, informational use, provided you keep all copyright, trademark, and other proprietary notices intact.

All other rights are reserved. This license does not permit you to republish, redistribute, sell, license, or create derivative works from Site content without our prior written permission.

4. Prohibited conduct

You agree not to:

  • Copy, reproduce, republish, frame, mirror, or redistribute the Site or its content, in whole or in part, except as Section 3 allows
  • Use the Site or its content to build, market, or operate a competing service
  • Use any robot, spider, scraper, crawler, or other automated means to access, harvest, or index the Site, except for search engines operating in accordance with our robots.txt file
  • Conduct text and data mining, or extract content from the Site, for the purpose of training, fine-tuning, or grounding artificial intelligence or machine learning systems, absent our express written permission (we expressly reserve all rights under applicable law to prohibit such use)
  • Collect, compile, or extract the names, biographies, credentials, photographs, or contact details of our personnel for marketing, recruiting, database, or directory purposes
  • Interfere with or disrupt the Site, its servers, or its networks, including through denial-of-service activity, malware, or excessive automated requests
  • Attempt to gain unauthorized access to any portion of the Site, any account, or any system connected to it
  • Probe, scan, or test the vulnerability of the Site or breach any security or authentication measure
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Submit a referral or other information about another person unless you are authorized to do so
  • Use the Site in a way that violates any applicable federal, state, or local law, or any court order or protective order
  • Use the Site to transmit unsolicited commercial communications, chain messages, or advertising

We may investigate and take appropriate action, including reporting conduct to law enforcement and pursuing legal remedies.

5. Intellectual property

The Site and all of its content — including text, article and newsletter content, expert biographies and credentials, photographs, graphics, illustrations, page layouts, design, look and feel, software, and code — are owned by Stokes & Associates or our licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

“Stokes & Associates,” the Stokes & Associates logo, and our other names, marks, and slogans are trademarks or service marks of Stokes & Associates, Inc. You may not use them without our prior written consent. Third-party names and marks appearing on the Site belong to their respective owners and are used for identification only; their appearance does not imply endorsement.

Where the Site describes or links to publications, book chapters, or articles authored by our professionals, those works may be subject to rights held by their publishers. Any use beyond personal reading requires permission from the applicable rights holder.

6. Information you send us

Our Refer a Case form asks for the limited details we need to open a file and run a conflict check. Complete only the fields on that form. Do not attach or paste medical records, depositions, reports, or other case documents, and do not send them by unencrypted email. Information transmitted through the Site is not secure and is not treated as confidential or privileged, and it may be reviewed by staff for conflict-check and routing purposes. If you submit information about another person, you confirm that you are authorized to do so. See our Privacy Policy for how we handle what you send.

For any comment, suggestion, idea, testimonial, or other material you voluntarily submit that is not confidential case information, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and display it in connection with our business, and you confirm that you have the right to grant that license.

7. Accuracy of content and third-party data

We work to keep the Site accurate and current, but content is provided “as is.” Statements about our services, personnel, credentials, methodologies, and experience may change, and articles or newsletters reflect the state of knowledge, data, and law at the time they were written.

Our published and referenced material may draw on third-party sources, including the U.S. Bureau of Labor Statistics Occupational Employment and Wage Statistics program, state employment security agency data, occupational and medical cost databases, and published research. We do not control those sources, and we make no representation about the accuracy, completeness, or currency of third-party data reproduced or summarized on the Site.

8. Links to third-party sites

The Site may link to websites we do not operate. We provide those links for convenience only. We do not endorse, control, or assume responsibility for the content, products, services, accessibility, or privacy practices of any third-party site, and accessing them is at your own risk.

9. Availability and changes to the Site

We may modify, suspend, relocate, or discontinue any part of the Site at any time, with or without notice. We do not guarantee that the Site will be available without interruption or free of errors, viruses, or other harmful components.

10. Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Stokes & Associates disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will meet your requirements, that it will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STOKES & ASSOCIATES, ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, or for any loss of profits, revenue, data, business, goodwill, or anticipated savings, arising out of or relating to your access to or use of — or inability to use — the Site, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

OUR TOTAL AGGREGATE LIABILITY arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100.00).

Louisiana limits. Nothing in this Section excludes or limits, in advance, our liability for intentional or gross fault that causes damage, or for causing physical injury, and any such exclusion or limitation would be null under Louisiana Civil Code article 2004. Nothing in these Terms limits any other liability that cannot be limited under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this Section may not apply to you.

This Section does not apply to, and does not limit, our obligations under any written engagement agreement for professional services, which are governed by that agreement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Stokes & Associates and its officers, directors, shareholders, employees, contractors, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law or the rights of a third party, or any material you submit through the Site.

13. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 5 through 18 survive any termination.

14. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any such dispute is the state or federal courts located in Jefferson Parish, Louisiana, or the United States District Court for the Eastern District of Louisiana, and you consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.

15. Informal resolution first

Before filing any claim, you agree to contact us at info@stokes-associates.com with a written description of the dispute and to work with us in good faith for at least thirty (30) days to resolve it informally.

16. Copyright complaints

If you believe content on the Site infringes your copyright, send a written notice to our copyright agent with: your contact details; identification of the work claimed to be infringed; identification of the material you say is infringing and its location on the Site; a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner; and your physical or electronic signature.

17. Changes to these Terms

We may revise these Terms at any time. The revised version takes effect when posted, and we will update the “Last updated” date above. Your continued use of the Site after a change means you accept the revised Terms. Please review them periodically.

18. General

  • Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. They do not modify, replace, or limit any separate written engagement agreement for professional services.
  • Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions stay in effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Headings. Headings are for convenience only and do not affect interpretation.
